Agreement
These terms apply to your use of www.theinkco.com and to any project you start with The Ink Co. (“we”, “us”). By using the site or engaging us, you agree to them. A signed proposal or statement of work for a specific project takes priority over these terms where they differ.
Using the site
You may browse the site and share links to it. You may not copy, scrape or republish its content, attempt to disrupt it, or use the project form to send spam or unlawful material.
Quotes and payment
Quotes are valid for 30 days. Work begins after you approve a quote and pay any deposit it lists. Invoices are due on the terms stated on the invoice. Printed goods and merchandise are produced only after you approve a final proof.
Proofs and approvals
Please check proofs carefully, including spelling, colors, sizes and quantities. Once you approve a proof, we are not responsible for errors in the approved version. Printed colors can vary slightly from screen colors and between production runs.
Revisions and changes
Each quote states the revisions included. Requests beyond that scope, or changes after approval, are billed at our current rates after we confirm the cost with you.
Ownership of work
Once you have paid in full, you own the final approved deliverables created for you, and we transfer the rights needed for you to use them. We keep ownership of preliminary concepts you didn’t select, our tools and templates, and any third-party assets, which are licensed to you under their own terms. We may show completed work in our portfolio unless you ask us not to in writing.
Materials you provide
You confirm that you own or have permission to use any text, images, logos or other material you give us, and you are responsible for claims arising from that material.
AI-assisted work
Some illustration and image work uses AI tools directed and finished by our artists. We will tell you when a deliverable includes AI-generated elements. The legal protection available for AI-generated material may be more limited than for fully human-made work.
Cancellations and refunds
You can cancel a project in writing at any time. You pay for work completed up to that point, and deposits cover work already started. Printed goods and custom merchandise can’t be returned once production starts, except for defects or our errors, which we will reprint or refund.
Limitation of liability
The site is provided “as is”. To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any project is limited to the amount you paid for that project.
Governing law
These terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Los Angeles County, California.
